Swenglish rants and åsikter

By Sweden I mean the powers that be. Politicians and courts. The latest case to be prosecuted is so ridiculous it would be laughable, if it wasn’t so frightening. A lot has been said about it already in various Swedish blogs and newspapers, so I thought I would spread the word to others not fluent in Swedish. After all, in this globalised world of the internet, links (which lie at the heart of the issue) are global by nature. Several links in this text lead to Swedish resources, as I have been unable to find English language resources covering this scandal (except for The Local).

The case is as follows: Canal+, one of Sweden’s largest rights holders to premium sports events, streams sports on their website. If you know the URL, it seems the stream is publicly accessible. An individual posted links to two ice hockey games on his website, and is now being prosecuted for linking to these games. The argument is that the links themselves made the streams accessible to the public. Anyone with a basic level of understanding of the internet and the technology involved realises the hollow nature of this claim. Most suppliers of premium streaming content have systems ensuring that only subscribers can access the streams. The whole case seems so preposterous that I’m in doubt as to whether media has correctly understood and reported the details of the claim. However, I’m simply relaying the information Swedish media is publishing.

Jag vet att det mesta jag skriver här kan anses stötande och extremt, men jag vill diskutera principen. Ha lite tålamod så kanske det klarnar.

Idag finns medicinsk behandling tillgänglig för de flesta i väst. Direkt anses detta vara ett framsteg, och så kan det mycket väl vara. Min fråga är vad detta leder till på lite längre sikt, alltså fem generationer framåt eller däromkring. Genom att behandla och kurera de som är sjuka, i vissa fall skulle dö, sätter vi ju evolutionens mekanismer ur spel. En genetisk defekt som i gamla tider hade lett till döden kan vi idag hantera och behandla så att individen får ett långt och normalt liv. Denna genetiska defekten leds då vidare vid barnanskaffning och kanske tom. förvärras om båda föräldrar bär på genen. Resultatet blir en allt sjukare befolkning. Det jag undrar är om detta verkligen är långsiktigt hållbart. Kostnaden för samhället för den medicinska behandlingen ökar allteftersom fler behandlas och fler sjukdomar ärvs.

Well, one post in Swedish, I suppose this should be in English then…

For the first time in my life I’ve been following the Confederations Cup. The only reason I knew of it was thanks to the game Football/Championship Manager. The championship as far as it’s gone now is so entertaining that it will share the priority that the World Cup and European Cup have in my football calendar. For those of you who have no clue what it is, it’s essentially the champions from each continent (North+Central American, South America, Europe, Africa, Asia and Australasia) playing in a pre-world cup championship. Of course, the current World Cup champions (Italy) and the host nation (South Africa) are also included in the line-up.

Nu har det kommit en ny dom från Regeringsrätten, angående insamlandet av IP-nummer i syfte att identifiera fildelare. Åsikterna om domens innebörd verkar gå isär, och själv är jag ingen jurist, så därmed inte i bättre stånd att tolka det hela. Trots det ska jag ge det ett försök, mer grundat i sunt förnuft än en precis tolkning av lagen.

Vi kan börja med de två ställen där jag läst om utslaget, där åsikterna verkar vara diametralt motsatta, iallafall om man skall se till rubriceringen. NyTeknik går ut med “Hårt slag mot Antipiratbyrån” medan DN påstår att “Ny dom påverkar inte IPREDlagen“. Nu är ju inte IPRED och Antipiratbyrån samma sak, men de är minst sagt tätt förknippade, vill jag påstå.
